The following news item appeared on Yahoo News recently:

A Darwin man has been fined $2,000 for filming himself masturbating while speeding along the Stuart Highway.The man was also carrying cannabis in the car boot and two plants on the back seat.He was pulled over by police on the Stuart Highway in July speeding at 147 kilometres per hour, south of Daly Waters.Brenton Alan Erhardt, 39, pleaded guilty in the Darwin Magistrates Court to dangerous driving.He also pleaded guilty to driving while unlicensed, carrying two cannabis smoking pipes, administering the drug and carrying a loaded rifle.

COMMENT:

Clearly this was budget movie, with a cast of one, but he had it all: guns, drugs, sex, a car chase…it was pure rock ‘n’ roll…but…

No indecent exposure charge?!

Obviously the Stuart Highway is a public place, and Brenton would have passed a lot of cars, buses, trucks, while he was giving his upstanding performance, but…

It appears that no one was offended enough either to report him, or to press charges

And if no one is offended, there can be no offence. Right?!

This brings up an important question: in this day and age, are people offended enough by an act of indecent exposure to warrant making it a crime? We don’t think so. What do you think?
